Notice of Privacy Practices

As required by the Privacy Regulations created as a result of the Health Insurance Portability and Accountability Act of 1996 (HIPAA)

This notice describes how medical information about you may be used and disclosed, as well as how you can get access to this information.

1. We Are Committed to Your Privacy

NextGen Male Medical Clinic is required by law to maintain the privacy of certain confidential health care information, known as Protected Health Information (PHI), and to provide you with a notice of our legal duties and privacy practices with respect to patients’ PHI. This notice describes your legal rights, advises you of our privacy practices, and outlines how NextGen Male Medical Clinic is permitted to use and disclose PHI about our patients.

NextGen Male Medical Clinic is also required to abide by the terms of the version of this notice currently in effect. In most situations, we may use this information as described in this notice without your authorization or opportunity to object, but there are some situations where we may use it only after obtaining your written authorization, as required by law.

We realize that these laws are complex, but we must provide you with the following important information:

  • Our obligations concerning the use and disclosure of your PHI
  • Your privacy rights regarding your PHI

The terms of this notice apply to all records containing your PHI that are created or retained by our practice. We reserve the right to revise or amend this Notice of Privacy Practices at any time. Any revision or amendment to this notice will be effective for all your records that our practice has created or maintained in the past and for any future records that we may create or maintain for you. Our practice will post a copy of our current notice in our offices in a visible location. You may also request a copy of our most current notice at any time.

2. We May Use or Disclose Your Protected Health Information (PHI) in Situations Described Below

  • Treatment: Our practice will use your PHI to treat you. This includes the provision, coordination, or management of healthcare and related services by one or more healthcare providers. This may include coordination with third parties such as laboratories, specialists, or pharmacies. Any of the people who work directly with NextGen Male Medical Clinic (doctors, nurses, medical assistants, etc.) or indirectly with any provider we refer you to may use or disclose your PHI to others who assist in your care at home, such as a spouse, adult child, or parent.
  • Billing: Our practice may use and disclose your PHI to bill and collect payment for the services and products provided. We may contact your insurance provider to check eligibility, which may require disclosure of some details of your treatment. We may also need to provide treatment details to collect payment from your insurance company. NextGen Male Medical Clinic will always provide the minimum PHI necessary for billing and payment collection. We are accountable to the Secretary of Health and Human Services to safeguard and protect your PHI.
  • Clinic Operations: We may need to disclose your PHI during normal business operations. This includes quality assessment, staff training, and cost management activities.
  • Appointment Reminders & SMS Communications: Our practice may use your PHI to contact you in the form of appointment reminders or other important communications. If you are not home, we may leave a message reminding you of your upcoming appointment.

By opting into SMS from a web form or other medium, you are agreeing to receive SMS messages from NextGen Male Medical Clinic. This may include messages for conversations, appointment reminders, and alerts. Message frequency varies, and standard message and data rates may apply. Message “HELP” for assistance or “STOP” to opt out at any time.

  • Treatment Options: Our practice may use and disclose your PHI to inform you of potential treatment options or alternatives.
  • Health-Related Benefits and Services: We may use your PHI to alert you to health-related benefits or services that may interest you.
  • Releasing Information: We may release your PHI to a designated family member or friend involved in your care.
  • Disclosures Required by Law: We will use and disclose your PHI when required to do so by federal, state, or local law.

3. We Will Notify You of Any PHI Breach

NextGen Male Medical Clinic is required by law to notify our patients in the event of a breach of their PHI when it has been, or is reasonably believed to have been, accessed, acquired, used, or disclosed in violation of privacy regulations.

4. Special Circumstances Requiring the Use and Disclosure of Your PHI

NextGen Male Medical Clinic may use your PHI without written authorization or opportunity to object in certain situations, such as:

  • Collecting payment for services
  • Releasing PHI to another healthcare provider for treatment or payment inquiries
  • Detecting or preventing healthcare fraud and abuse
  • Complying with public health reporting requirements
  • Assisting in health oversight activities such as audits or investigations
  • Cooperating with law enforcement when required by warrant or law
  • Supporting national defense or security functions
  • Preventing or responding to serious health threats to individuals or the public
  • Complying with workers’ compensation laws
  • Assisting coroners, medical examiners, and funeral directors in the performance of their duties
  • Facilitating organ or tissue donation when authorized

Any release of PHI outside of the situations listed above will only be made with written authorization from you. This authorization must specify the recipient, the information disclosed, and how the information will be sent. Authorization may be revoked in writing at any time prior to disclosure.

5. Your Rights Regarding Your PHI

NextGen Male Medical respects your rights to your PHI, including:

  • The right to access, copy, or inspect your PHI.
  • The right to request amendments if information is incomplete or inaccurate.
  • The right to request an accounting of disclosures made in the past six years, excluding disclosures for treatment, payment, or operations.
  • The right to request restrictions on certain uses and disclosures of your PHI.
  • The right to file a complaint with our clinic or the Secretary of the U.S. Department of Health and Human Services without retaliation.
